This website is owned and operated by P F & I, Inc. aka Pet Friendly. These Terms and Conditions set forth the terms and conditions under which you may use our website and services as offered by us. By accessing or using the Website, you approve that you have read, understood, and agree to be bound by these Terms. Certain products and services on our Site may have additional terms that apply (for example, if you enroll in our Treats loyalty program or you subscribe to our Auto ship subscription program).
In order to use our Website and/or receive our services, you must be at least 18 years of age or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this Website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
We reserve the right to make changes to our Site, this Agreement and other service terms, such as our Privacy Policy at any time. Each time you use our Site, you should visit and review the then current terms that apply to your transactions and use of our Site. If you do not agree to be bound by the then current terms, your sole remedy is not to use our Site. If any terms of this Agreement or other service terms are deeded invalid, void, or for any reason unenforceable, any such term shall be deemed severable and shall not affect the validity and enforceability of any other terms.
Pet Friendly attempts to be as accurate as possible with product descriptions and any other descriptions; however, Pet Friendly does not warrant that product or any descriptions or other content on the Site are accurate, complete, reliable, current or error-free. If a product offered by Pet Friendly is not described, your sole remedy is to return the product.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the Website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.
Product information and orders
Products displayed on the Website can be delivered only in accordance with United States export laws and regulations. By placing your order with us, you are representing to us that you will comply with all applicable laws and that you are of legal age and, furthermore, you agree to hold us harmless from your failure to comply with these requirements.
Product pricing and availability are subject to change without notice. The display of product color will depend on your individual monitor; Pet Friendly cannot guarantee the accuracy of your monitor’s display. Certain products are only available in random colors which Pet Friendly has no control over the exact color.
All orders placed through the Website are subject to Pet Friendly’s acceptance. This means that Pet Friendly may refuse to accept or may cancel any order, whether or not the order has been confirmed, for any or no reason, and without liability to you or anyone else. If your credit card has already been charged for an order that is later cancelled, Pet Friendly will issue you a refund.

Warranties & responsibility for services and products
When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.
Ownership of intellectual property, copyrights and logos
The Products, Services and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Pet Friendly. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. All Intellectual Property rights are protected by the United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the Website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website. Nothing in the Terms transfers to you any right, title or interest in any content on the Website, including any intellectual property or content of third parties included on the Website.
The copyrights and other rights to the materials on our Website, or other Pet Friendly owned or operated platforms (i.e. blogs, social media accounts, etc.), are owned by Pet Friendly. No further publication or commercial use may be made of these materials without the express written permission of Pet Friendly.

Submission of product ideas or information
With regard to the submission of information to Pet Friendly, please note that Pet Friendly does not want to receive confidential or proprietary information, including product ideas, from you through this Website or otherwise unless you have written agreement with Pet Friendly related to the sharing of such information. Any information that Pet Friendly receives from you through this Website, must comply with all applicable federal, state, local and international laws and regulations, and, other than your personally-identifiable information that is encompassed by the terms of our Privacy Policy, will be deemed to be non-confidential and non-proprietary. By transmitting non-confidential and/or non-proprietary information via this Website or otherwise without a written agreement with Pet Friendly relating to your submission, you understand and agree that Pet Friendly may use that information for any purpose whatsoever without obligation to you. You will be solely responsible for the content of any submissions you make.
User-generated content and product reviews
We, at Pet Friendly, welcome your comments and submissions regarding our company, products, Website, blog, and/or services, which might include personal information about you and your use of the Website or Pet Friendly products.
As a condition to your submission of any comments, reviews, photos, or other material, including social media posts associated with hangtags related to Pet Friendly (“User-Generated Content”), you agree to grant Pet Friendly an irrevocable, royalty-free, worldwide, and non-exclusive license to use, reproduce, distribute, publish, display, and create derivative works of the User-Generated Content, in any media now or hereafter known. Pet Friendly may display your User-Generated Content for other users to see, together with your name and associated social media account profile, if applicable.
Pet Friendly may request to use or display the User-Generated Content you post on Facebook, Twitter, Instagram, or Pinterest by sending you a direct message. You understand, agree, represent and warrant that: 1) such User-Generated Content may be used on the Website and/or other Pet Friendly maintained websites, marketing materials, or social media pages; 2) you are 18 years of age or older and have the full power and authority to submit the User-Generated Content and grant the licenses herein; 3) the User-Generated Content will not violate anyone else's right, including copyright, trademark, privacy or other rights; and 4) your User-Generated Content complies with all applicable laws, rules and regulations, as well as any applicable third-party agreements, including without limitation Instagram, Facebook, Twitter, and Pinterest Terms of Use.
You may not transmit any information that is or contains threatening, libelous, defamatory, scandalous, inflammatory, pornographic, profane, or otherwise unlawful, obscene or objectionable material, as determined by, and in the sole discretion of, Pet Friendly. You will be solely responsible for the content of any submissions you might make.
Pet Friendly has the right to remove or refuse to post any User-Generated Content for any or no reason, in its sole discretion. Pet Friendly cannot review all material before it is posted on the Website, or ensure prompt removal of objectionable material after it has been posted. Accordingly, Pet Friendly is not responsible or liable for the content or information that others post or transmit to the Website, for any error, defamation, libel, slander, omission, falsehood, obscenity, profanity or other objectionable material contained in any such information, or for the conduct of any Website user.
Customer account
By creating a Registered Customer Account on the Website, you will be able to move through the checkout process faster, store shipping and billing information, view past orders, and track shipments. An account is not required to make purchases via the Website. If you do not wish to set-up an account, you can process to checkout as a “Guest”.
Right to suspend or cancel user account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

To the maximum extent permitted by applicable law, Pet Friendly (or its directors, officers, employees, consultants, and agents) assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Right to change and modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. Preference of law and dispute resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of State of Alabama, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in either Baldwin or Mobile County. Our failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
